I. Definitions

Application Form
A standard application form formulated, with an electronic version available, for preparing single standard reservations, cancellation of overnight reservations or accessing other services available on the system rezerwuje.pl.
User
User is of private status who is aware of the laws and physics of the Civil Code.

Travel Operator
Polish Travel Quo Vadis LTD.

II. REZERVATION

  1. Reservations are made on rezerwuje.pl system only by correctly filling in the application form and sending it with the services chosen.
  2. In the event of incorrectly completing the application form the user bears all personal responsibility for any action.
  3. The Operator is not accountable for the unavailability to access the reservation system, for security or any other reason regardless of the contributing Operator.
  4. The Operator holds the right to refuse access to the rezerwuje.pl system for matters of security and any inaccurate irregularities.
  5. Reservations are approved provided that a charge has been debited from the users valid credit card account or through an approved and validated bank transfer.
  6. The basis currency is the Polish Zloty (PLN). The price presented in EURO and USD is converted at closing rate at the end of each day. Any minor discrepancy in the price is due to the various exchange rates applied by the credit card authorization service center or the bank.
  7. In case of hotels from Orbis Hotel Group there are no loyalty bonuses added to Client's account due to membership to Orbis Gold Club, Miles and More and other Accor's loyalty programs

III. FORMS AND CONDITIONS OF PAYMENT

CREDIT CARD
  1. In the case of making payment via credit card, the user is obliged to enter and complete all the required credit card details.
  2. The authorization and charging process is executed on the rezerwuje.pl website through a secure encoded 128-bit protocol system that is directly connected to eCard.
  3. The required amount owing will be charged through the system from the credit card after a 7 day period starting from the initial date of reservation, no later than two working days before the elected date on which the user chooses to take advantage of the reservation service.
  4. In the case of the lack of funds on the credit card, the amount due towards the payment of the reservation, the reservation becomes ineffective.
BANK TRANSFER
In the case of a bank transfer payment, the user is required to send the bank transfer confirmation via fax on: (022) 6521461 or (022) 6522113 no later than 3 days prior to the commencement of the service. The recipients' details are as follows::

VAT Invoice
According to current valid tax laws, Polish Travel Quo Vadis Ltd. issues a VAT invoice for services on a clients claim within 7 days from the date of receiving payment for services requested (credit card charge or bank transfer to our account). If a client doesn't fulfil all requested details reagarding the purchaser or 7 days elapse from receiving the payment, Polish Travel Quo Vadis Ltd. is no longer authorised to issue the invoice.

IV. CONFIRMATION

  1. The system rezerwuje.pl includes services available On-Line, confirmed automatically on the basis of the special allotment services reserved for the User, as well as services entailing the Operator's confirmation.
  2. In the case of a required confirmation by the Operator, the confirmation is sent within a 2 day working period to the e-mail address specified in the reservation form.
  3. The confirmation includes all essential details about the reservation or the notification of no vacancies at the indicated period.

VI. OPERATORS EXTENDED RESPONSIBILITY

  1. The Operator is forced to make the best effort in the realization of the service similar in standard to the original as well as in the required time, as specified in the reservation form, only if the realization of the specified service is impossible to be carried out by the Operator
  2. The Operator can offer an alternative service, similar to that of the original at the specified period completed in the reservation form, if the realization of the initial service is impossible to be carried out for reasons outside the scope of the operator.
  3. In the case of the User not authorizing an alternative service proposed of similar standard, realization of the service becomes impossible for reasons other than listed in pt.1 or their execution would be linked with the excessive payment according to the Operator charge, then the operator is required to refund the exact amount the User was charged for the service, in reference to pts. 6 & 7
  4. A received refund of payment to the User exhausts all additional claims of compensation the User may have.
  5. The Operator does not take on responsibility for any inconvenience transition caused that may occur at any service providers eg. Hotel costs, shortage of water, heating, electricity and air-conditioning as well as for the inconvenience occurrence caused in a disconnection of services eg. Repairs or maintenance of swimming pools, or other incidences.
  6. In the case of unforeseeable circumstances, independent of any other actions, life catastrophes, strikes, onset of war or other situations that make it impossible for the realization of the service as agreed, the operator is released from any obligated services.

VII. CANCELLATION

  1. In the case of canceling a Reservation the following charges are implemented:
    • 50 PLN ( approx. 12 Euro) - as long as the cancellation is made 3 days prior to the initial commencement date of the service, when the User is expected to take advantage of the service requested;
    • 100% of the total reservation if the cancellation is made following the 3 day period signalizing initial commencement date of the reservation (in the case of an overnight stay - 100% of the cost is charged for the first night);
    • 100% of the total reservation cost if the User resigns from using the service without making a formal cancellation, by completing and sending the cancellation form, through the system;
    • 100% of the total reservation cost, if the User is a no-show or refuses to utilize all the reserved services requested without making the necessary changes.
  2. In the case of making a cancellation the full amount owed will be reimbursed via a bank transfer to the bank account specified by the User on the cancellation form.
  3. In case of cancellation for special offer with price description, Operator recognize as valid condition information showed directly with price. Non refundable are especially offers with note: "Super Offer!!! The 1st night is non-refundable in case of any change or cancellation."

VIII. PERSONAL DATA

Making a reservation on the Internet website rezerwuje.pl the User hereby agrees to have their personal data recorded in the system database of rezerwuje.pl as well as the Operator - Polish Travel Quo Vadis Ltd. The recorded data will be processed by rezerwuje.pl and the Operator in order to finalize the reservation, allowing the next reservations to be done faster and for marketing purposes (such as sending a newsletter by e-mail or fax, submitting the company name on the clients list of rezerwuje.pl) in accordance with the full extent of the Polish Protection of Personal Privacy Law dated 29.08.1997 . Users are entitled to view and make changes to their personal data records.

IX. ACCEPTATION OF RESERVATION CONDITIONS ON THE INTERNET

Selecting the option "I Agree" indicates, that the Client understands and accepts the all the conditions of the Regulations. If the Client does not accept the conditions of the Regulations the result is a return to the main service page rezerwuje.pl.

DEFINITIONS

Hotel
An establishment (building) that provides lodging, meals, and other services to the travelling public on a commercial basis.
Guest
A visitor to Hotel who pays for accommodations, meals or other services and uses the Reservation System of Operator to make the Reservation.
Operator
NETMEDIA S.A., Warsaw Stock Exchange Company with its headquarters located on 5A Gen. Fieldorfa Street segment E, 03-984 Warszawa, Poland.
Reservation System
on-line Hotel reservation system accessible at the domain name rezerwuje.pl (the "Website") enabling visitors to the Website to book Hotel services.
Order
an electronic document (form), which is the only means of making Reservations.
Reservation
an accepted and confirmed by the Operator Order of requested services (for example an overnight hotel stay).
Voucher
an electronic document sent by the Operator to the Guest confirming the Reservation. The Voucher should be presented at the Hotel as proof of purchase.

SUBJECT AGREEMENT

The subject agreement defines the terms and conditions under which Operator provides Guest with Reservation services of overnight stays and other services in Hotels.

RESERVATION OF SERVICES

The purchase of overnight accommodation or other tourism services is executed by means of the completion and dispatch of Order.
The client is obligated to complete the order form correctly. Operator does not take any responsibility for the negative aftereffects resulting from the incorrect completion of the Order form by the Client.
It is the responsibility of the Client to verify whether the Voucher, confirmation of the services booked, was received successfully. In the case when this document is not received, Operator must be informed of this fact as soon as possible by Guest.
Operator does not guarantee a successful delivery of the reservation confirmation document and does not take responsibility for the negative aftereffects resulting from a missing Voucher during the stay of the Client at the hotel.

PRICES

The exhibited prices are per room, apartment, or other accommodation, per night. All prices include VAT taxes.
The exhibited prices include Hotel breakfast, unless explicitly stated. In the case where breakfast is not offered in the price, the Client will be informed of this fact during the reservation process.
Guest accepts that the exhibited prices are subject to change within prior notice. Operator will confirm the actual price during the reservation process and will provided it on Voucher (reservation confirmation document). Operator does not charge any additional fees for acting as an intermediate in the reservation of overnight accommodation as well as other ordered services.

PAYMENT OPTIONS

The only legally binding unit of currency for payments is the Polish Zloty (PLN). The exhibited prices in foreign currencies (EURO, USD, GBP) are approximations, converted according to the daily average currency exchange bank rate. There can be minor differences in the final price charged due to differences in the exchange rate used by the credit card authorization centre or Guests bank. There are two different forms of payment: credit card and bank transfer.

CREDIT CARD

Reservation price is automatically authorized once the Guest has completed and successfully submitted Order. Authorizations are executed by eCard - an authorized credit card centre utilizing an encoded, secure connection. Operator reserves the right to block the authorized funds until Order confirmation, up to 7 working days from the time of their authorization.
Guests Credit Card is debited at the moment of Reservation confirmation by the Operator.
The Operator has the right to reject Order in case when Guests credit card funds are insufficient to cover the costs of the ordered services or the credit card vendor rejects the transaction operation.

BANK TRANSFER

Guests can pay for ordered services by way of a bank transfer while complying with the following conditions:
Operator must receive complete payment within 3 working days before the date of first night stay. If payment is not received, the Operator has the right to terminate Order.
Upon receiving payment Operator will confirm Guest the Reservation by Voucher. In the case when immediate Reservation confirmation is required, the Client shall send Operator proof of payment to the following fax number: +48 (22) 567 31 51 or to the following e-mail address: biuro@rezerwuje.pl
Payment via bank transfer should be made to the following bank account of Operator: Kredyt Bank Account Number: 90 1500 1878 1218 7006 4975 0000 (IBAN) PL90 1500 1878 1218 7006 4975 0000 (BIC) KRDBPLPW.

PAYMENT DIRECTLY AT THE HOTEL

Booking not guaranteed.
In the case of making a Booking with this form of payment the Client is not obligated to make payment via rezerwuje.pl. The booking will be made free of charge at the Hotel chosen by the Client. The booking is guaranteed until the specified time listed on the confirmation email/voucher. Payment for the service ordered takes place directly at the Hotel by the client. An Invoice for the rendered services is issued by the Hotel. In the case where a late arrival is possible please contact the Hotel directly before the deadline listed on the confirmation email/voucher. We also urge the Client to advise the hotel if the booked accommodation will not be rendered by the Client.
ATTENTION: The booking will automatically the cancelled at the moment of a no show at the Hotel at the listed time on the confirmation email/voucher.
Booking guaranteed.
In the case of making a Booking with the form of payment the Client is obligated to provide the Clients credit card details in order to make a guarantee by the Hotel of the booking. The credit card information will be sent to the Hotel, where the booking was made. The Operator will not charge the Clients credit card and is not the issuer of the Invoice. In order to ensure your booking the Hotel may pre-authorize the card or charge it for the correct amount. Pre-authorisation of the card means that the Hotel may check and charge the card until the realisation of the transaction. Pre-authorisation or a charge of the credit card may be in the amount of the first day stay at the Hotel or for the whole amount of the stay at the Hotel. The charged amount is equal to the amount of the services ordered. The Booking at the Hotel is guaranteed for the entire day. In the case of a delayed Booking cancelation or a no show of the Client at the Hotel, the Hotel may charge the Client for the entire amount of the Hotel stay as listed on the confirmation email/voucher.

INVOICES

Operator will issue to the Guest a VAT invoice according to the goods and services tax bill of Poland within 7 days of the conclusion of the service at the Hotel.
If Guest incorrectly provides invoice data Operator will not be able to make changes to the VAT invoice after a 7 day period from the conclusion of the service.

ADDITIONAL SERVICES

Any additional services exploited by Guest at the Hotel or at another entity (for example parking, laundromat facilities, cable television, mini-bar, climate taxes and others) not reserved through Operator, will be the sole responsibility of Guest.

CONFIRMATION OF RESERVATION

Operator enables two different types of Reservations depending on accessibility of services:
  • ON-LINE Reservation - services are accessible in real-time (online), in which case Operator instantly confirms Reservation and sends Guest the Voucher to the indicated by Guest e-mail address.
  • ON-REQUEST Services - services are accessible on-request (available off-line), in which case Operator checks availability of services at the hotel or other entity and has 24 hours (during workdays) and 48 hours (during non-workdays) to confirm Reservation, from the moment the Order was completed by Guest.
  • For successful and fully paid Reservations Guest, along with Order confirmation, also receives Voucher which is an essential document to be presented at the Hotel or other entity to ensure proper services

CANCELATION OR MODIFICATION OF A RESERVATION

Any modifications or cancellations of a Reservation must be performed using the electronic form accessible in the Reservation System. Operator is not obligated to accept modifications or cancellations requests in any other form.
Any changes or cancellation made by Guest need to be verified and confirmed by Operator in writing.
If no restrictions apply Operator will modify or cancel Reservation without any additional costs to Guest.
The actual Terms and Conditions of modifications and cancellations may be different than the general rules presented below depending on the Hotel and particular offer details. Operator will inform Guest of the actual and binding Terms and Conditions in a clear and concise manner during the booking process on the order form as well as Voucher (confirmation of Reservation). In the case when no specific conditions are listed in the order form or Voucher, the following Terms and Conditions shall apply:
No charges apply for cancellations or modifications of a Reservation if made at least 72 hours before the day of the service commencement.
Charges equal to 100% of the cost of the first night stay apply for cancellations or modifications of a Reservation if made less than 72 hours before the day of the service commencement.
Charges equal to 100% of the cost of the full stay apply for "no shows" without prior cancellations or modifications of a Reservation.
For properly made cancellation of the reservation Operator will reimburse Guest full amount charged, minus any cancellation costs resulting from a particular offer or the general Reservation Terms and Conditions. Operator does not take responsibility for the currency exchange costs.

LIABILITY

If the originally reserved services are for whatever reasons unattainable Operator will try to the best of its ability, to provide Guest with as similar as possible in price, standard and duration alternative services. If Guest rejects the alternative proposition of a similar service Operator will reimburse Guest the full amount charged.
In any event total Operators liability is limited to the amount that Guest was charged for Hotel services while making a Reservation through the Reservation System. After that amount is reimbursement to Guest Operator is free of any additional claims of action by Guest.
The lack of confirmation of the reservation means there are no accommodations left for online sale. The operator does not take any responsibility for the present, available status of free accommodations in a hotel.
Operator takes great care to present "up to date" and accurate information in the Reservation System. However Operator is not the owner of Hotel facilities presented in the Reservation System, therefore:
  • Operator does not take any responsibility for any damages suffered by Guest at the hands of the Hotel staff.
  • Operator can not be held responsible for incorrect information provided by the Hotel itself in the Reservation System.
  • Operator does not take responsibility for liabilities resulting from 'no vacancies' at the Hotel which for example can occur when the Hotel sells more accommodation than it actually holds.
  • Operator does not take any responsibility for any inconvenience or unpleasant occurrence at the hotel that result for example from renovation of heating systems, inaccessibility to recreational services, pool renovation, a water or power shortage and any other similar occurrences.
  • Operator can not be held liable in crisis situations beyond Operators control, such as, natural disasters, strikes, wars, biohazards, etc, where the realization of the Reservation is impossible, in which case Operator is released from any responsibility to fulfil Reservation obligations and does not partake in any consequences regarding the legal binding of these Terms and Conditions.

COMPLAINTS

Any complaints associated with the services rendered by the Hotel should be filed by Guest directly with the Hotel prior to or at the time of departure or at the latest within 48 hours after the completion of the service.
If Guest approaches Operator for whatever reason with a complaint about the services rendered by the Hotel, Operator shall confer the complaint with the Hotel with the objective of ensuring that the complaint is dealt with as quickly as is practically possible by the Hotel.

GUEST INFORMATION

The data collected by Operator when Guest books a reservation through the website, such as Name, telephone and fax numbers, email address and Invoice details is used to process and book Reservation and to notify the Guest about Reservation details by email or fax. As a members of the Reservation System Guests will occasionally receive updates from Operator about special offers, new services, and other noteworthy news items. However, the Guest may always decline to receive these email and fax messages.

IN CONCLUSION

The Guest certifies that he has read the User Agreement and agrees to be bound by it.
The User Agreement was created under the strict guidelines of Polish law. The Polish internal laws, without regard to the principles of conflicts of laws, will govern this agreement and any dispute of any kind that arises between Guest and Operator.
In the case of where one point of the Agreement is invalid, this does not affect the remaining points of the Agreement.
The Operator reserves the right to change the "Terms and Conditions" of the Agreement at any time with out prior notice.

We act as an intermediate between hotels and users in order to provide our users with the possibility to search and book hotel accommodation online. Our service is based on information provided by hotels. Although we do our utmost best to ensure that all information provided on this website is accurate, we cannot guarantee that all information is comprehensive and error-free nor can we be held responsible for interruptions or non-delivery of information.
The prices on our site are very competitive. All of our prices are the room prices for your whole stay - if not mentioned differently. We also show the highest price for a room to compare it with, which is given by the specific hotel on our webpage for the following months (crossed out values). Free of charge

Our service is free of charge. Unlike many other parties, Booking.com will not add any additional fees, like a reservation fee, to the room rate.

Cancellation

Please follow the instructions in the confirmation email in case you need to cancel your stay. If you cancel according to the cancellation policy of the hotel, it will be free of charge. We recommend you read the cancellation policy of the hotel carefully. If you cancel later than requested by the hotel or do not show up, the hotel might charge you a fee which is in most cases an equivalent for 1 night stay. Note, Booking.com will not charge you any cancellation fee whatsoever.

We work as an agent between the users and hotels, giving our customers the possibility to search and book the accommodations online. Our system is based on the informations supplied by hotels. We do our best to make sure all informations on our webpage are valid and correct. We cannot, however, guarantee all informations to be accurate, as we cannot take any responsibility for disrupting the delivery of informations or not delivering the informations needed.
The prices on our webpage are highly competitive. All prices are the rooms' prices for all your stay (if not stated otherwise). Please check the room information in order to get to know what is excatly included in the price.

Privacy protection

Credit card guarantee

The hotels need to get your credit card details to guarantee your reservation. Your credit card details will be transferred directly to the hotel, in which the reservation took place. When making the reservation you do agree to the general rules and cancellation policy of the hotel. Depending on the offer the payment will be processed by Travel Online or the hotel, in some cases the credit card is given only to guarantee the reservation and you pay at the hotel for your stay. You will be informed about the payment form of the offer by email, which is the confirmation of reservation.
We do care for your credit card details. We use the SSL (Secure Socket Layer) technology to encrypt the details. In that way we can guarantee each transaction to be proceeded 100% safe.

No fees

Our service is free to use. On contrary to other companies Travel Online will not implement any additional fees (for example: reservation fee or service fee) to your reservation nor to the room price.

Cancellation

If you would like to cancel your reservation, we ask you to browse through the reservation confirmation which you get by email. If you do cancel your reservation according to the cancellation policy of the hotel and Travel Online, that process will be free. But if you cancel your reservation later then the hotel demands or you do not arrive without prior cancellation of your reservation - the hotel has the right to bill your credit card according to its cancellation policy (in most cases that is the price for one accommodation).

1. DEFINITIONS:

Form
Standard character document, in electronic version, which is the only form of reservation or reservation cancelling of an accommodation or other touristic service available in rezerwuje.pl service.
Booker
A person or a corporation with act of law availability according to civil code.
Operator

2. RESERVATION:

1. Reservation in rezerwuje.pl service is made by filling out and sending the reservation form of selected service.
2. The booker takes all responsibility for filling the with incorrect data.
3. Special request for hotels regarding accommodations for non-smokers, joined rooms, late of early arrivals etc. will be directed to the hotel but they cannot be confirmed or guaranteed.
4. We do demand giving all the surnames for all reserved rooms. We cannot process the reservation of accommodations in USA or Canada without a surname and name (or initail of name).
5. The presented offer has only available hotels.
6. Operator does not take any responsibility for the lack of reservation system's availability because of conditions not related to the Operator.
7. Operator has the right to temporary close the rezerwuje.pl service for the time necessary for removing any errors.
8. Reservation is valid after the payment is done by credit card, e-transfer, bank transfer or post transfer.

3. FORMS AND CONDITIONS OF PAYMENT:

All payments for reservations made in rezerwuje.pl service are transferred to the Operator's Partner.
CREDIT CARD
1. In case of electronic payment by credit card the form must be filled with all necessary data.
2. Authorization and settlement are made by using the terminal on rezerwuje.pl webpage connected directly with Dotpay's server with 128bits encrypted protocol.
3. Demanded quote, calculated in the form is blocked on a credit card and will be processed within 7 days after reservation is done on the form, but not later than 2 working days before the Booker starts to use the reserved service.
4. In case of the lack of possibility to block the calculated quote on a credit card for the reservation - the reservation is not valid.
BANK TRANSFER AND MAIL TRANSFER

Reservations with payments made by bank or mail transfers are confirmed after the payments are confirmed. The price and availability of accommodations can change during that time. If the offer is no longer valid after the payment is confirmed (price change, no rooms, etc) another offer will be submitted to the Booker (regarding the hotel of the same or close standard), a surcharge is offered or the payment is returned.
Payments for additional services
1. Payments for additional services not included in the order (additional accommodations, minibar, etc) must be made by the Booker at the hotel.
2. The currency is PLN. Prices in EUR or USD are calculated according to the NBP's exchange rate. All differences in payments could appear due to different echange rates of payments realized by the credit card operator or the bank. The Operator and the Partner do not take any responsibility for that issue.

4. CONFIRMATON:

1. rezerwuje.pl system services are confirmed automatically but there are also services which require individual confirmation by the Operator.
2. A voucher is the document which confirms the reservation. A voucher has got all necessary informations for the accommodation process: date of arrival, number of rooms, number of accommodations, services uncluded in the room price (accommodation + breakfast or only accommodation), reference number of reservation.
3. In case of a service which requires confirmation by the Operator, the confirmation is send within 2 working days on the email address supplied by the Booker in the reservation form.
The confirmation has got reservation details or - in some cases - information about the lack of accommodations in the specified date. The reservation is finished after the confirmation has been received.

5. VAT INVOICES:

1. The Operator's Partner has the obligation to compose an invoice within 7 days from the date od finishing the service.
2. According to the act of product and service tax the Partner is obliged to compose VAT profit margin invoice.
3. In case the Booker submitted incorret details for the invoice, the Operator's Partner has no possibility to compose an invoice or change it later then 7 days after the service has been finished.

6. THE RANGE OF OPERATOR'S RESPONSIBILITY:

1. The Operator is obliged to realize the service of similar standard and date which was described in the form when the reservation service appears to be impossible to realize on the Operator's fault.
2. The Operator could offer to realize the service of similar standard and date which was described in the form when the reservation service appears to be impossible to realize on other objects' fault.
3. In case the Booker does not agree to realization of the service of similar standard, the realization is impossible to be done because of other reasons than those described in pt 1 or its realization would implicate other significant cost according to the Operator - the Operator will be obliged to return the payment for that service with consideration of pt.6 and pt.7.
4. The return od payment give out any Booker's demands on the issue of unfinished service.
5. The return of payment mentioned in pt.3 will be send on the Booker's bank account submitted in the form not later then 1 month beginning on the day when the service was to be started.
6. Operator does not take any responsibility for any temoprary inconveniences appearing on the subcontractor's side, for example in the hotels - temporary lack of water, electricity, heating, etc. and for inconveniences which are caused by lack of temporary disconnections, for example the maintanence of swimming pools, etc.
7. The maps with marked locations of the objects are provided by external service Google Maps. The Operator and Global Hotels & Travels (rezerwuje.pl) does not take any responsibility and does not guarantee the correct data displayed on them. To check the location of objects please use their addresses, provided during booking process.
8. In case of extraordinary incidents, which are independent from both of the sides, natural disasters, strikes, wars or other situations that make the realization of service impossible according to the agreement, Operator is discharged from the commitment.

7. CHANGE OR CANCELLING OF RESERVATION:

1. The change or cancelling of the ordered service must be made by using the forms available on rezerwuje.pl webpage.
2. All changes or cancellations made by the Booker must be written confirmed by the Operator to be valid.
3. The Operator will change the reservation without any additional costs if the conditions of the offer do not state otherwise.
4. Cancellation conditions may vary, depending on the offer and hotel. The Operator guarantees to send the Booker such informations in clear and simple way during the reservation process. The superior cancellation conditions are conditions included in the confirmation of a reservation. If thy are not included the general conditions of cancellations apply.
5. To get a total or partial refund of reservation payment the information about reservation cancellation shall be sent to us not later than on the day described as the last possible day of cancellation in confirmation of reservation.
6. In case of cancellation of reservation paid by Dotpay Ltd online payment system and First Data Polska S.A. (PolCard) on our webpage, we do bill a cancellation fee which is 3% of reservation value - which does not depend on the date of cancellation.
GENERAL CONDITIONS OF CANCELLATION:
a. Operator does not bill the Boker with any fees in case the cancellation of reservation took place not later then 3 working days (by working day we mean a day between Monday and Friday without holidays) from the date of first day of starting the service and was paid by standard bank transfer outside the payment system operated by Dotpay Ltd and First Data Polska S.A (Polcard).
b. In case the cancelled reservation was paid by Dtpay Ltd online payment system or First Data Polska S.A. (PolCard) on our webpage and the cancellation took place ot later then 3 working days (by working day we mean a day between Monday and Friday without holidays) from the date of frst day of starting the service we do bill the cancellation fee which is 3% of reservation value.
c. Operator will bill 100% of the total cost of reservation if the Booker cancells the reservation later then 3 working days before the first day of service starts - if the hotel will not allow to bill the Booker only for the first night.
d. Operator will bill 100% of the total cost of reservation if the Booker resigns from the ordered service without its previous cancellation or without changing it, using the forms on rezerwuje.pl webpage.
e. Operator will bill 100% of the total cost of reservation if the Booker does not use the ordered service in time (does not show).
7. In case of cancellation of reservation Operator will pay back the cost to the Booker with previous billing him with cancellation costs, according to the offer or general conditions of reservation, for the bank account specified by the Booker or credit card used during reservation process. Operator does not take any responsibility for differences caused by the daily fluctuations of exchange rates.
8. Informations regarding the date of cancellation are specified during the reservation process. Please keep in mind the time zone differences between Poland and Asia, USA or other European and non-European destinations.

8. PERSONAL DATA:

When making a reservation on rezerwuje.pl webpages the Booker agrees to implementing his personal data in the database of rezerwuje.pl and Operator. Data will be processed by rezerwuje.pl and Operator only for realization of reservation purposes, to make another reservations easier and for marketing purposes (sending newsletters by email or fax, putting the company's name on the list of clients of rezerwuje.pl) according to 29.08.1997 act of processing the personal data. The Booker has the right to view and change his personal data.

9. ACCEPTATION OF RESERVATION CONDITIONS IN THE INTERNET:

Marking of the "I accept" option means the Booker understands and accepts the conditions of regulations. If the Booker does not accept them - he will be returned to the main page of rezerwuje.pl.

10. DETAILED HOTEL RESERVATION CONDITIONS:

1. The Booker has the obligation to show the Voucher at the reception of the hotel and he is accommodated according to the Voucher. The exception is a reservation, in which a Voucher is submitted directly to the hotel by fax and hotel agreed to that. If the travellers arrive at different time each of them must have his own Voucher.
2. The complaints must be reported directly at the hotel. We cannot be responsible for troubles that could have been solved during the visit in the hotel if the hotel was informed about them. We will not accept complaints received later then two weekes after the Boker's departure from the hotel.
3. The rooms for 3 or 4 persons might be equipped with separate beds or joined beds (double) plus additional bed or two double beds. Most of the hotels do not have a 4p. or 3p. rooms with a separate bed full size bed for each guest.
4. Hotels cannot guarantee 3 or 4 single beds in rooms for 3 or 4 persons. Such rooms could have: one double bed and one single (3p), two double beds (4p), one double bed and two single (4p).
5. Please keep in mind the hotels are sometimes being renewed. In such situations the hotels take all available actions to limit the inconveniences for their guests. However we cannot accept complaints about the payback of costs if there is a refit being made in the hotel during the stay.
6. The standards of each hotel are marked according to country cathegories rules. The standards of room equipment in different countries may vary although the number of stars would indicate the same standard of service. The Operator and his Partner are not responsible for the difference in hotel standards caused by the cathegories rules in different countries.
7. All reservations of rooms for daily use do not include breakfast.
8. Overbooking - it's an extremaly rare situation in which the previously booked hotel cannot provide the accommodation because of the sale of larger number of accommodations than those available in the object. In such situation the hotel must provide accommodation in an alternative hotel (the same cathegory, similar localization from the city center), to which the Client gets by taxi and the hotel covers the cost of it. The Client can refuse to use the alternative and then the payback is made but the Client must search for another accommodation for himself and no additional recompenses are done. If the Client accepts the alternative he can notify us about the overbooking but no additional recompenses are done for him.
RATES
9. All rates relate to the room (with bath or shower for personal use, if not stated otherwise) and they also include breakfast (or only the room), service fees and governmental taxes. The operating currency is stated in the price list. In case the prices vary depending on the day of the week, the days for which rates are indicated are specified for every period the rates apply.
10. It may happen there is a price confirmed on the reservation, which is higher than the price from the list. It happens extremaly rare (once for a few years) because the hotel bills additional fee related to a difficult period. The rate on a confirmation of reservation will replace that one from the price list and you will be able to accept it or not accept.
11. Some periods (Christmas, New Year, etc) can cause higher prices in some cities. These are not craft fairs but out prices may come close or even exceed the prices from the list and they should be treated the same way as in the case of craft fairs.
12. We do reserve the right to change the rates at any time (you will be informed about that also after the reservation is done and confirmed) due to craft fairs, change of governemntal taxes or other reasons that are beyond out control.
13. The payment for service not included in the order (additional accommodations, etc) must be done by the Booker at the hotel before the departure.
14. When making a reservation for a double room with an add-on for a child please keep in mind the hotel has the right to bill his client for breakfast for the child (payment directly at the hotel). The child using the add-on must be of 18months -10years old. For children above the age of 10 years additional bed must be reserved (for example: for two adults and a child above 10 years old a room for three persons must be reserved).
15. The cradles are for children up to 18 months old. The Client must inform the Operator about the travelling with a child. If the child sleeps together with the parents in one bed, then such information should be sent to us by email.
HOTELS OUTSIDE EUROPE
16. In USA the twin/double idea has the opposite meaning than in Europe. But for your comfort when you demand twin beds (separate) we will ask for two beds, when you demand double beds we will ask for "joined" (marital) bed.
17. In most hotels outside Europe the rates for rooms for 3 or 4 persons apply to one room with two double beds. If additional bed is required - an additional fee could be billed, which must be paid directly at the hotel, because making a reservation before the arrival could be impossible.
18. In many hotels there will be no additional bed for a child if the child's stay is free or with lower price and before the departure additional fee for breakfast could be billed. If there is a need for separate bed for a child a room for three persons bust be booked - in that case the discount will not be applied.

11. CONDITIONS OF GROUP RESERVATIONS:

1. There are longer periods regarding cancellation for group reservations and they usually require a pre-payment (partial). You will be notified about the detailed reservation conditions when our offer is sent.
2. The conditions of group reservations are not negotiable.
3. The hotels usually considers a group when there are at least 10 persons in it. All other enquires that do not fulfill that condition must be made directly in the system.
4. Every enquiry sent to us must enclose the following details:
- country,
- city,
- date,
- number of nights,
- type of rooms and number of people
- hotel standard
- budget
5. Every offer is sent for the specific order so the changes made in it could affect the price.
6. The answer for group enquiry could take up to 72 hours (working days).
7. The payments for group reservations must be made according to conditions enclosed in the offer. If you do not make the payments in specified period the reservation will be cancelled automatically and no reclamations or demands will be accepted.

12. EMERGENCY NUMBER:

There is an emergency number available 24h/day for the clients, which is listed on the voucher.

1. Zakres zastosowania - Hotel World Online

Niniejsze Ogólne warunki handlowe dotyczą samodzielnych rezerwacji, dokonywanych za pomocą międzynarodowego systemu rezerwacji hotelowych firmy HRS. Przez Internet można zarezerwować maksymalnie sześć pokoi. Rezerwacje więcej niż sześciu pokoi dokonywane są za pośrednictwem Biura Obsługi Klienta. Niedozwolone jest dzielenie zapotrzebowania na więcej niż sześć pokoi na kilka rezerwacji po maksymalnie sześć pokoi każda. W przypadku szczególnego zapotrzebowania na pokoje związanego z targami, konferencjami, imprezami i rezerwacjami grupowymi (10 lub więcej pokoi) należy skorzystać z modułów do sporządzania zapytań grupowych i konferencyjnych znajdujących się na stronie rezerwuje.pl

2. Stosunek umowny z HRS

HRS umożliwia rezerwowanie za pomocą międzynarodowego systemu rezerwacji hotelowej świadczeń (związanych z podróżą) wykonywanych przez osoby trzecie. We własnym imieniu firma HRS nie oferuje żadnych świadczeń związanych z podróżą. Dlatego wskutek dokonania rezerwacji między klientem a HRS zostaje zawarta jedynie umowa o pośrednictwo, w odniesieniu do której nie mają zastosowania przepisy §§ 651a nn. niemieckiego kodeksu cywilnego.

3. Rezerwacja

a) Każda rezerwacja jest przekazywana przez HRS w imieniu klienta do odpowiedniego hotelu jako deklaracja zamówienia.
b) Pośrednictwo w systemie rezerwacji hotelowej jest dla gości hotelowych bezpłatne. W związku z tym zabroniona jest odsprzedaż pokoi zarezerwowanych za pomocą HRS. Niedopuszczalne jest również przekazywanie kontyngentów pokoi osobom trzecim po cenach wyższych niż ceny HRS. HRS zastrzega sobie prawo zablokowania dostępu danego klienta do systemu w przypadku nieprzestrzegania podanych zasad. - Niedopuszczalna jest również cesja lub sprzedaż roszczeń wobec hotelu. W takich przypadkach hotel ma prawo anulować rezerwację - zwłaszcza, jeśli klient przy cesji/sprzedaży na rzecz osób trzecich podał nieprawdziwe informacje dotyczące rodzaju rezerwacji lub płatności.

4. Umowa i płatność

a) Umowa dotycząca każdorazowego świadczenia jest zawierana na czas rezerwacji bezpośrednio między klientem a wybranym przez niego hotelem. Potwierdzona przez HRS cena za wynajęcie pokoju jest uiszczana bezpośrednio w hotelu lub pobierana przez hotel z karty kredytowej podanej w procesie rezerwacji (w przypadku ofert specjalnych - "Hot Deal"). Wszelkie roszczenia i obowiązki wynikające z umowy hotelowej, a w szczególności ewentualne roszczenia i obowiązki z tytułu §§ 651a i następnych niemieckiego Kodeksu cywilnego, powstają wyłącznie między osobą rezerwującą a wybranym przez nią hotelem.
b) Pokój zostaje zarezerwowany już w trakcie czynności rezerwowania. Rezerwacja obowiązuje również bez potwierdzenia dokonania rezerwacji. System wysyła potwierdzenie rezerwacji do klienta pocztą elektroniczną, a w przypadku wybrania odpowiedniej opcji, także w postaci krótkiej informacji SMS-em. Z przyczyn technicznych HRS nie może sprawdzić, czy klient otrzymał potwierdzenie wysłane pocztą elektroniczną lub SMS-em. Fakt ten nie ma wpływu na ważność rezerwacji.

5. Rodzaj rezerwacji

a) Standardowa rezerwacja utrzymywana jest przez hotel zasadniczo do godz. 18.00 czasu miejscowego. W przypadku niepojawienia się klienta do godz. 18.00 czasu miejscowego rezerwacja jest anulowana przez hotel bezpłatnie. Po upływie tego czasu wygasa roszczenie odnośnie do noclegu. W przypadku przyjazdu po godz. 18.00 czasu miejscowego osoba rezerwująca / gość hotelowy ma obowiązek poinformowania hotelu o przewidywanej godzinie przybycia i uzyskania potwierdzenia, że hotel otrzymał tę informację. W takim przypadku hotel może uzależnić utrzymanie rezerwacji od podania przez klienta numeru karty kredytowej jako gwarancji przyjazdu.
b) Gwarantowana rezerwacja utrzymywana jest przez hotel przez całą noc. W przypadku nieterminowego anulowania rezerwacji lub niepojawienia się klienta hotel może wystawić rachunek za koszty noclegu.
c) W przypadku pakietów świadczeń i cen powiązanych ze szczególnymi warunkami obowiązują indywidualne warunki anulowania rezerwacji w danym hotelu; zawarte w pakiecie świadczenia dodatkowe (np. bilety wstępu, bilety na koncert itp.) nie podlegają bezpłatnemu anulowaniu.

6. Zmiany i anulacje

a) W celu uniknięcia nieporozumień, wszelkich zmian i anulacji należy dokonywać zawsze za pomocą systemu rezerwacji. Dla dokonania terminowej zmiany lub anulowania rezerwacji miarodajne jest wpłynięcie odpowiedniej informacji do rezerwuje.pl, HRS lub odpowiedniego hotelu. Ważnych anulacji można dokonywać tylko na stronie internetowej HRS za pomocą zakładki "Zmiana i anulacja", telefonicznie pod numerem +49 221 2077-600 (od poniedziałku do soboty w godz. 7-24, w niedziele i święta w godz. 8-22) lub faksem pod numerem +49 221 2077-666.

W przypadku anulowania przydzielany jest numer anulacji. Stanowi on dowód anulacji i z tego względu należy go koniecznie zachować. W przypadku anulacji po upływie terminu anulacji HRS jedynie przesyła wiadomość klienta do hotelu. W takiej sytuacji hotel podejmuje decyzję o opłacie za anulację. W przypadku wcześniejszego wyjazdu hotel może rościć sobie prawa do ewentualnego odszkodowania.
b) Anulacja w przypadku nieznanego użytkownika.

W celu uniknięcia nadużyć w bezpłatnym systemie rezerwacji hotelowej i nieobciążania hoteli fałszywymi rezerwacjami, HRS zastrzega sobie prawo do anulowania w poszczególnych przypadkach niegwarantowanych rezerwacji, o ile nie ma możliwości skontaktowania się z klientem pod wskazanym przez niego numerem telefonu. W takich przypadkach nie występuje roszczenie do noclegu. To samo dotyczy sytuacji, gdy z adresu e-mail podanego przez klienta dokonywano w przeszłości wielu rezerwacji, które nie zostały wykorzystane, lub gdy zapytania zwrotne wykonywane tą drogą przez HRS pozostają bez odpowiedzi. Aby zapobiec anulowaniu rezerwacji wskutek podejrzenia, że dana rezerwacja została dokonana z umyślnym zamiarem jej niewykorzystania, klient ma możliwość dokonania rezerwacji gwarantowanej przez podanie numeru swojej karty kredytowej.

7. Kategorie hoteli i informacje na temat hoteli

a) Międzynarodowa klasyfikacja hoteli oparta na systemie gwiazdek stanowi niewiążącą informację o standardzie danego hotelu. Przedstawiona tutaj klasyfikacja hoteli opiera się na ocenie własnej danego hotelu, która jest ewentualnie sprawdzana przez HRS według własnego systemu oceny, oraz na doświadczeniach zebranych przez HRS i jego klientów. Wszelkie dodatkowe opisy i informacje o hotelu oparte są również na informacjach własnych hotelu.
b) Ponadto, dla lepszego rozeznania, w HRS hotele oceniane są przez tych, którzy robią to najlepiej: Klientów. Ocena klientów generowana jest automatycznie na podstawie anonimowej analizy wszystkich ocen klientów, a tym samym jest ona subiektywną opinią klientów i nie odzwierciedla poglądów HRS. HRS zastrzega sobie prawo nieuwzględniania ocen klientów, zwłaszcza, jeśli zachodzi podejrzenie pozytywnej lub negatywnej manipulacji. Przy tworzeniu oceny klientów nie są uwzględniane ani zapisywane dane osobowe klientów.

8. Ceny pokoi ustalone w umowie

a) Wszystkie ceny HRS (ceny specjalne na dany rok oraz aktualnie najkorzystniejsze ceny dnia) są umownie określonymi cenami za pokój, obowiązującymi dla rezerwacji dokonywanych za pomocą międzynarodowego systemu rezerwacji hotelowej HRS.
b) Rezerwacja jest dokonywana po najkorzystniejszej cenie dnia, obowiązującej aktualnie w systemie rezerwacji hotelowej HRS, która jest dostępna w systemie dla wybranej daty przyjazdu. Podczas dokonywania rezerwacji automatycznie są uwzględniane ceny "last minute", ceny sezonowe, weekendowe oraz ceny specjalne dostępne w bazie hoteli systemu HRS. Wiążące ceny za pokój są gwarantowane przez hotel w odniesieniu do każdej dokonanej rezerwacji.
c) Poza atrakcyjną ceną dzienną HRS niektóre hotele dostępne w systemie HRS oferują specjalnie oznaczoną cenę "Hot Deal". W odróżnieniu od cen dziennych HRS obowiązują tu szczególne warunki (np. termin uprzedniej rezerwacji, ograniczone możliwości anulowania, obciążenie karty kredytowej itp.), które można znaleźć w osobnych wskazówkach i które są wyświetlane przed dokonaniem rezerwacji. Specjalne warunki dokonywania rezerwacji mają zastosowanie także w odniesieniu do określonych cen hoteli, które są rezerwowane w HRS za pomocą systemu zewnętrznego.
d) Podane ceny to ceny za pokój za wybrany okres; w przypadku niektórych pokoi śniadanie jest wliczone w cenę, w przypadku innych nie - podobnie w różny sposób mogą być podawane ceny weekendowe. Hotele są zobowiązane mocą ustaw, również wobec HRS, do podawania ceny końcowej uwzględniającej podatki. Ceny podaje jednak tylko i wyłącznie hotel. Prosimy o informację w razie niezgodności ceny faktycznej z podaną. Z przyczyn technicznych na liście możliwych do zarezerwowania hoteli podane ceny końcowe dotyczące niektórych hoteli mogą nie zawierać podatków. Cena końcowa zostanie jednak podana przed dokonaniem rezerwacji na stronie z opisem hotelu. Podatki i opłaty w zagranicznych hotelach zależą od przepisów lokalnych. W przypadku hoteli w Polsce w cenę jest zawsze wliczony ustawowy podatek VAT. Hotele oznaczone tekstem "Exclusive Price" zadecydowały, że w HRS swoje usługi będą oferować zawsze o 10% taniej niż w innych internetowych portalach rezerwacyjnych, które mają takie same warunki rezerwacji. W przypadku odejścia od tego zobowiązania przy wyjeździe otrzymają Państwo od hotelu zwrot co najmniej 20,- euro za pokój/noc. e) Ceny pokoi przesyłane z zewnętrznego systemu podlegają stałej aktualizacji w HRS. Pomimo to nie można zagwarantować, że ceny pokazywane na liście hoteli będą w danej chwili aktualne. Wiążąca cena za pokój wyświetlana jest dopiero po wybraniu hotelu na stronie z rezerwacją danej oferty.

9. Lista hoteli do natychmiastowej rezerwacji

Odpowiednio do informacji dotyczących podróży i czasu pobytu oferowana jest najlepsza cena HRS dostępna w hotelach zarejestrowanych w systemie.
Jeśli wstępnie określono walutę, ceny za pokój i śniadanie są wyświetlane dla lepszej orientacji w sposób niewiążący w wybranej walucie. W wiążącej ofercie dotyczącej wybranego hotelu podana jest obowiązująca cena za pokój w odpowiedniej walucie rozliczeniowej.

10. Ochrona danych osobowych

Podane przez klienta dane są przetwarzane elektronicznie przez HRS. Dane te są przekazywane innym podmiotom jedynie w zakresie niezbędnym do dokonania rezerwacji. Dane nie są przekazywane w żadnym innym celu. W pozostałym zakresie przy przechowywaniu danych przestrzegane są ustawowe regulacje dotyczące ochrony danych osobowych. Oznacza to, że dane osobowe klienta usuwane są z reguły 60 dni po odbytym noclegu. HRS nie przekazuje danych osobom trzecim ani nie wykorzystuje ich w inny sposób bez zgody klienta. W przypadku rejestracji i przekazywania dalej informacji, nie zawierają one danych osobowych.
Dane osobowe będą przetwarzane przez rezerwuje.pl wyłącznie w celu realizacji rezerwacji, ułatwienia dokonywania kolejnych rezerwacji oraz w celach marketingowych (np. przesyłanie informacyjnego newslettera pocztą elektroniczną lub faxem, umieszczenie nazwy firmy w liście klientów na stronie rezerwuje.pl) zgodnie z przepisami ustawy z dnia 29.08.1997 r. o ochronie danych osobowych.
